This website is operated by Vesmir. Throughout the site, the terms “we,” “us,” and “our” refer to Vesmir.

By accessing our website or purchasing from us, you engage in our “Service” and agree to be bound by the following Terms & Conditions (“Terms”), including any policies referenced or linked within.

These Terms apply to all users of the site, including browsers, customers, merchants, and contributors of content.

Please read these Terms carefully before using our website. If you do not agree, you may not use our services. We reserve the right to update, change, or replace any part of these Terms at any time. Your continued use of our website after changes have been made constitutes your acceptance of those changes.

Our store is hosted on Shopify Inc., which provides us with an e-commerce platform to sell our products.

 

2. ONLINE STORE TERMS

By agreeing to these Terms, you confirm that you are:

✔   At least the age of majority in your country or region, or have provided consent for minor dependents to use this site.
✔  Using our products legally and will not violate any applicable laws.


Prohibited use:

4. PRICING & PROMOTIONS

  • All prices are listed in AUD and include GST (if applicable).
  • Prices and promotions are subject to change without notice.
  • Only one discount code can be applied per order unless otherwise stated.

5. ORDERS & PAYMENTS


5.1 Placing an Order

By placing an order, you confirm that:

✔   Your details are accurate and complete.
✔   You have legal authority to use the selected payment method.
✔   You understand that once an order is placed, it cannot be modified or cancelled if it has already been processed.

We reserve the right to refuse or cancel any order if fraud, incorrect pricing, or stock issues are suspected.


5.2 Payment Methods

✔   We accept credit cards, debit cards, and other payment methods listed at checkout.
✔   Payments are processed securely by third-party providers.

Vesmir is not responsible for:

  • Delays, errors, or disputes arising from third-party payment processors.
  • Any payment disputes, which must be handled directly with the provider.


6. SHIPPING & DELIVERY

  • We currently ship within Australia only.

  • Orders are processed within 1–2 business days, excluding public holidays

  • Delivery timeframes depend on your location and the shipping method selected at checkout.

6.1 Shipping Liability Disclaimer

  • Once an order has been handed to the shipping carrier, the risk of loss or damage transfers to the customer.

  • Vesmir is not liable for delays, loss, or damage caused by Australia Post or any shipping provider after dispatch.

  • Shipping timeframes are estimates only and are not guaranteed. Delayed deliveries do not qualify for refunds.

6.2 Delivery Without Signature (Authority to Leave)

By placing an order, you consent to your parcel being delivered with Authority to Leave unless otherwise specified. This means your parcel may be left at the shipping address without requiring a signature.


Once a parcel is marked as Delivered by Australia Post — including GPS or photo confirmation — it is considered successfully delivered. Vesmir is not responsible for parcels that are lost, stolen, or damaged after delivery has been confirmed.

For added security, we recommend using a delivery address such as a workplace, PO Box, or Parcel Locker.

 

7. RETURNS


7.1 Return Policy

  • We accept returns within 30 days of purchase for unworn jewellery in its original condition and packaging.
  • For hygiene reasons, earrings cannot be returned or exchanged.
  • Returned items must be in their original, unworn condition. 
  • Returns may be rejected if items show signs of wear, damage, or improper handling.
  • Customers are responsible for return shipping costs unless the item is faulty.

7.2 Incorrect  or Damaged Items

If your jewellery arrives damaged or you receive the wrong item, you must contact us within 48 hours of delivery with clear photos of the item and packaging. Our team will assess the issue and provide a resolution.

 

8. WARRANTY

We offer a 6-month manufacturer’s warranty from the date of purchase, covering manufacturing defects.

Our warranty covers defects present at the time of purchase and does not apply to damage occurring after the item has been worn, mishandled, or exposed to substances that cause deterioration.

If a fault is deemed a manufacturing defect by our after-sales team, we will offer a replacement or store credit at our discretion. Refunds are only provided when required by law.


8.1 What is Not Covered?

Our warranty does not cover:

✘   Tarnishing, scratches, or discolouration from wear
✘   Accidental damage, loss, or neglect
✘   Breakage due to improper storage or handling
✘   Contact with hand sanitiser, cleaning agents, soap, or cosmetic products, which can cause discolouration.

9. INTELLECTUAL PROPERTY

All content on this website, including images, text, logos, and product designs, is the intellectual property of Vesmir. Unauthorised use, reproduction, or distribution is strictly prohibited.

 

10. LIABILITY & DISCLAIMER

  • Vesmir is not liable for any indirect, incidental, or consequential damages arising from the use of our website or products.
  • We do not guarantee that your use of the website will be uninterrupted, secure, or error-free.
  • Customers are responsible for reviewing product materials before purchasing. Vesmir is not liable for allergic reactions, skin sensitivities, or any personal health conditions that arise from wearing our jewellery.
  • Vesmir’s total liability, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the customer for the specific product in question.
  • We disclaim all warranties, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement, to the maximum extent permitted by law.

 

11. GOVERNING LAW

These Terms are governed by the laws of Brisbane, QLD, Australia, and any disputes will be subject to the exclusive jurisdiction of the courts in that region. These Terms. 

To the maximum extent permitted by law, any implied consumer guarantees, warranties, or conditions are excluded from this agreement.

 

12. CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time. The most current version will always be available on this page. Your continued use of our website constitutes acceptance of any updates.

15. FORCE MAJEURE

Vesmir shall not be held liable for failure to fulfill orders or obligations due to events beyond our control, including but not limited to natural disasters, pandemics, shipping disruptions, cyber-attacks, or government restrictions.

 

16. DISPUTE RESOLUTION

If a dispute arises, both parties agree to first attempt good-faith negotiation. If unresolved, disputes shall be referred to mediation or arbitration before legal action is taken.
